Ad Marking for Telegram Ads in Russia (2026): erid, ORD, ERIR, the 10k+ Registry and the 3% Levy

The moratorium of the FAS (Russia's Federal Antimonopoly Service) to 31 December 2026 only pauses penalties for advertising in Telegram (Pravo.ru); marking rules apply in full. The first FAS cases hit bloggers with proper marking (The Bell): it does not shield you, but its absence is a separate violation.

What marking means#

An ad needs the label "Реклама" ("Advertising"), advertiser details and an erid — an ad token issued by an ORD (licensed ad data operator) for a registered creative. Stats and documents go to the ORD by the 30th of the month after placement, then to ERIR, Russia's unified register of online advertising (ORD-A).

Channel posts and Suggested Posts#

In direct post deals the parties mark ads themselves: contract, ORD registration, erid and label in the post, report by the 30th. The channel owner, as distributor, is equally liable under Art. 14.3 of KoAP, Russia's Code of Administrative Offences (Pravo.ru). Suggested Posts, Telegram's built-in paid posts, are not marked automatically either.

RKN registry for 10k+ channels#

Under Law 303-FZ, channels with 10,000+ subscribers must register with Roskomnadzor (RKN), the communications regulator, via the Gosuslugi portal within 10 working days of crossing the threshold (eLama). Unregistered ones cannot carry ads, collect donations or be reposted. Advertisers using them face, per placement: individuals up to 2,500 ₽, sole traders and officials up to 20,000 ₽, small businesses up to 250,000 ₽, medium and large up to 500,000 ₽.

3% levy and foreign agents#

Since 1 April 2025 distributors, ad system operators and intermediaries pay 3% of quarterly online ad revenue (Art. 18.2 of the Advertising Law); advertisers only when contracting a foreign party. RKN computes it from ERIR data, no return needed (eLama). According to practitioners, resellers add it to euro cabinet top-ups with commission and VAT (aksanov.digital).

Since 22 March 2024 ads on "foreign agent" resources, or for them, are banned (Law 42-FZ): individuals 4,000–20,000 ₽, companies 100,000–500,000 ₽ (Consultant).
